Terms of Use
These Terms of Use ("Terms") form a legal agreement between you ("you") and ShiftPath ("ShiftPath", "we", "us") governing your use of the ShiftPath iOS application and any related services (together, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use the App. By using the App you represent that you meet this requirement and that you have the legal capacity to enter into these Terms in your jurisdiction.
2. License
Subject to these Terms, ShiftPath grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not:
- Copy, modify, distribute, sell, or lease any part of the App.
- Reverse engineer or attempt to extract the source code, except where applicable law expressly permits.
- Use the App for any unlawful purpose, or to harass, abuse, or harm another person.
- Bypass rate limits, technical restrictions, or subscription verification.
3. Not a medical, therapy, or crisis service
ShiftPath is not a medical device, not a therapy service, and not a crisis hotline. The App, including the AI Coach, is a self-help tool. It does not diagnose, treat, or cure any condition, including gambling disorder. It is not a substitute for advice from a qualified medical or mental-health professional.

4. The AI Coach
The AI Coach generates replies using a large language model operated by Anthropic. By using the AI Coach, you understand and agree that:
- The replies are generated automatically and may be inaccurate, incomplete, or inappropriate. Do not rely on them for medical, legal, financial, or other professional advice.
- Your messages are transmitted to Anthropic for processing as described in our Privacy Policy.
- The AI Coach is not a person and is not a counselor.
- If you express crisis-related content, the App may interrupt the conversation and present crisis resources.
- Free-tier access is rate-limited (currently ten sessions per UTC day). Premium subscribers receive unlimited access subject to fair-use limits.
5. Subscriptions and in-app purchases
5.1 Products
ShiftPath offers the following products, processed by Apple via the App Store:
- Premium Monthly — auto-renewing subscription, US$9.99 per month, with a 7-day free trial.
- Premium Annual — auto-renewing subscription, US$59.99 per year, with a 7-day free trial.
- Premium Lifetime — one-time purchase, US$89.99, non-renewing.
Prices may vary by region. The exact local price and any applicable taxes are shown on the in-app purchase screen before you confirm.
5.2 Free trial
Where a 7-day free trial is offered, the trial begins when you start it. If you do not cancel at least 24 hours before the end of the trial, you will be charged the full subscription price and the subscription will renew at the end of each billing period.
5.3 Auto-renewal
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
- Your Apple ID will be charged for renewal within 24 hours before the period ends, at the price displayed at purchase, unless you change your subscription.
- You can manage and cancel your subscription at any time in Settings → [your name] → Subscriptions on your Apple device.
- Cancelling a subscription stops future renewals; it does not refund the current billing period.
5.4 Lifetime purchase
"Lifetime" means the lifetime of the App as a published service. We will make reasonable efforts to keep the App available; however, the lifetime entitlement does not guarantee perpetual operation if the App is discontinued.
5.5 Refunds
Refunds for App Store purchases are handled by Apple in accordance with the App Store Terms of Service. Please request refunds via reportaproblem.apple.com.
5.6 Family Sharing
Subscriptions and the lifetime purchase support Apple Family Sharing where enabled in App Store Connect.
6. Your account and data
You are responsible for maintaining the security of your Apple ID and any account credentials you use with the App. You can delete your account and all associated data at any time via Settings → Account → Delete Account, or by emailing us. See the Privacy Policy for details on how we handle your data.
7. Disclaimers and warranties
The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.
We do not warrant that the App will be uninterrupted, error-free, or that it will produce any particular outcome regarding your relationship with gambling. Any reliance on the App is at your own risk.
8. Limitation of liability
To the maximum extent permitted by applicable law, ShiftPath shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of these Terms or the App shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US$50.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or use the App in a way that harms us, other users, or third parties. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
10. Changes to these Terms
We may update these Terms. Material changes will be announced in-app at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
11. Governing law and disputes
These Terms shall be governed by and construed in accordance with the laws of the country or jurisdiction in which you reside, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction in that country or jurisdiction, unless mandatory consumer-protection law of your residence requires otherwise.
Nothing in these Terms limits any non-waivable rights you have under the consumer-protection laws of your country of residence.
12. Apple-specific terms (App Store EULA addendum)
This Section 12 applies to your use of the App as licensed through the Apple App Store. In the event of any conflict between these Terms and Apple's standard terms, Apple's terms will control with respect to the matters they address.
- Acknowledgment: These Terms are between you and ShiftPath only, and not with Apple Inc. ("Apple"). ShiftPath, not Apple, is solely responsible for the App and its content.
- Scope of license: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service, except that the App may also be accessed and used by other accounts associated with you via Family Sharing.
- Maintenance and support: ShiftPath is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty: ShiftPath is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be ShiftPath's sole responsibility.
- Product claims: ShiftPath, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ShiftPath, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual-property infringement claim.
- Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address: ShiftPath. Contact for any questions, complaints, or claims: support@shiftpath.app.
- Third-party terms of agreement: You must comply with applicable third-party terms of agreement when using the App.
- Apple as third-party beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
